Terms of Service

1. Acceptance of Terms

By accessing or using the Gayuma StarFlow platform ("Service"), you ("User", "you", "your") agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

If you do not agree with any part of these Terms, you must not use the Service.

2. Description of Service

Gayuma StarFlow provides a QR-code-based customer feedback and review management platform. The Service allows businesses to:

• Generate unique QR codes that customers can scan to submit feedback
• Route high-rated feedback to their Google Business Profile
• Receive lower-rated feedback privately via a dashboard inbox
• View analytics, export feedback data, and manage multiple locations

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To use the Service, you must register for an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use at info@gayuma.in

You must be at least 18 years old and operate a legitimate registered business to create an account.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must NOT:

• Generate fake or incentivised reviews — You may not offer rewards, discounts, or any consideration in exchange for customers leaving Google reviews through our platform
• Violate Google's review policies or any third-party platform's terms of service
• Use the Service to harass, deceive, or defraud customers or competitors
• Attempt to reverse-engineer, copy, or resell any part of the platform without written permission
• Upload or transmit malicious code, viruses, or harmful content
• Use automated bots or scripts to interact with the Service
• Misrepresent your business identity or location

5. Subscription & Payment

Access to paid features requires a valid subscription. Key terms:

• Billing Cycle: All plans are billed annually upfront in Indian Rupees (INR).
• Payment Methods: We accept UPI, credit/debit cards, net banking, and other methods supported by our payment gateway.
• Auto-Renewal: Subscriptions auto-renew at the end of each annual period unless cancelled before the renewal date.
• Price Changes: We will notify you at least 30 days in advance of any price changes before they affect your subscription.
• Taxes: Prices shown are exclusive of applicable GST. GST will be added at checkout as per Indian tax regulations.

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, design, text, graphics, and QR code generation technology — are owned by Gayuma StarFlow and protected by applicable intellectual property laws.

You retain ownership of your business data and customer feedback data. By using the Service, you grant us a limited licence to process and store this data solely to provide the Service to you.

You may not copy, reproduce, distribute, or create derivative works from any part of our platform without our prior written consent.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Uninterrupted, error-free, or secure access to the Service
• Specific outcomes such as a guaranteed increase in Google rating or review count

Results vary based on your business, customer volume, and other factors outside our control.

8. Limitation of Liability

To the maximum extent permitted by Indian law, Gayuma StarFlow and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Loss of business, revenue, or profits
• Changes to Google's algorithms, policies, or review systems
• Actions taken by Google regarding your Business Profile
• Data loss due to technical failures

Our total liability to you in any calendar year shall not exceed the total subscription fees paid by you in that year.

9. Termination

Either party may terminate this agreement:

• By You: You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period.
• By Us: We may suspend or terminate your account immediately if you violate these Terms, particularly the Acceptable Use Policy. We may also terminate with 30 days' notice for any other reason.

Upon termination, your access to the Service will cease. You may export your data before termination. We will retain data for 30 days after termination, after which it will be deleted.

10. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in [Your City], India.

Before initiating any legal proceedings, both parties agree to attempt to resolve disputes amicably by written notice. If unresolved within 30 days, the dispute may be escalated.

11. Changes to Terms

We may update these Terms from time to time. When we do, we will notify you via email and/or a prominent notice on your dashboard at least 14 days before changes take effect.

Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service before the effective date.
